SC grants time for AAP to clear Rouse Avenue premises by Aug 10

New Delhi, Jun 10 (Reporter) The Supreme Court Monday granted more time to the Aam Aadmi Party (AAP) to vacate its office premises situated at Rouse Avenue in Delhi as the said land belonged to the Delhi High Court The AAP had filed an undertaking before the Supreme Court Registry last week saying that it will vacate the office premises occupied by them at Rouse Avenue by August 10. A Vacation Bench of Justice Vikram Nath and Justice Sandeep Mehta extended the deadline after Senior Advocate Abhishek Manu Singhvi, representing the AAP, urged the Court for more time. AAP in its Undertaking before the Supreme Court Registry stated that they shall hand over vacant and peaceful possession by August 10. The premises in question had to be vacated till June 15, 2024, as it has already been allotted to the Delhi High Court in 2020. Earlier on March 4, 2024, a bench of Chief Justice of India (CJI) DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra had held that the AAP was unlawfully occupying the premises since 2015 because the land originally had been allotted to the Delhi High Court. However, considering the elections, the apex court had given AAP time till June 15 to vacate the premises. The top court had also permitted AAP to move the Land and Development Office (L&DO) for allotment of new land and asked the L&DO to communicate its decision to AAP within four weeks. AAP had then approached the Delhi High Court seeking more time to vacate the premises. On June 5, the Delhi High Court rejected AAP’s plea seeking an order from the Union government to allow the national party to use a housing unit, presently in occupation of a Delhi minister, as its office temporarily. Justice Subramonium Prasad of the Delhi High Court had directed the Union government to consider the request of the party within six weeks, as the petitioner is a national political party that cannot be overlooked. The court had also asked the Centre to decide and file a detailed reply as to why even one housing unit from the general pool cannot be allotted to it when all other political parties have similar accommodations for this purpose...////...
