New laws ensure public and national security: J&K DGP

Srinagar, July 1 (Reporter) Director General of J&K Police R R Swain on Monday said that the three new criminal laws will maintain a balance to win any war while keeping the constitution intact. The Jammu and Kashmir police during the day registered a slew of FIRs under the newly enacted Bharatiya Nyaya Sanhita (BNS) as new Criminal Laws came into force across the country today. The DGP said the centre has struck a great balance as it ensures public security and national security. “These laws keep a tremendous balance keeping in mind the constitutional values and morality that will provide public safety, security, national security, and national integrity", Swain told media persons here. “How will you win the war? It should not happen that safeguarding individual rights you will sink the boat in which you are riding,” he said, adding “The boat is very important, and keeping it afloat is important,” he added. The DGP said during the past three decades about 45000 people were killed in J&K, that included 6000 security personnel, 23000 terrorists and 12,000 civilians. “There is a feeling among victims that those who commit crimes were going unpunished…… We have evidence that 12,000 civilians died at the hands of terrorists, who themselves acted as judges, prosecutors and police….This has happened and we can’t escape from it,” Swain said. “They need justice. Justice can be done when the truth comes out. The truth will prevail only when we will work without any fear. … The investigating officer will take the statement without fear, you will record your statement without fear in the court…Normal rule of law will prevail when there is no fear or minimum fear but if fear grows, investigating officer fears, prosecutor fears, judge fears and the system is hijacked,” he said. He said those who are committing a crime are alleging such rule of law does not exist. “To bring rule of the law the fear has to be brought down,” he added. The DGP said that so far the police and security forces have strongly fought the battle against militancy. "The adversary does not want rule of law. We want that. These new laws are a booster and enabler and provide a helpful framework. And through these laws we can fight those who disturb the rule of law with responsibility keeping in view our limitations and punish them accordingly in the court of law,” he added...////...
