Mumbai, Sep 9 (Reporter) The Supreme Court on Monday suspended the conviction awarded to artist Chintan Upadhyay and also granted him bail in double murder case, his lawyer Amit Desai told media here.
Upadhyay was convicted on charges of conspiracy to murder his estranged wife Hema Upadhyay and her lawyer Harish Bhambhani.
His sentence has been suspended pending hearing on his appeal before the Bombay High Court, he said.
On December six last year, the Bombay High Court had refused to suspend his sentence while observing that prima facie materials were available against the convict, however, confession of co-accused Pradeep Rajbhar, which implicated Upadhyay, was found to be corroborated by various circumstantial pieces of evidence, including close circuit TV camera footage, call detail records (CDR) and the recovery of belongings.
Upadhyay was convicted for the offence punishable under Section 120B (conspiracy) read with Section 109 (abetment) of the Indian Penal Code.
The Sessions Court on October 10 last year, sentenced Upadhyay to rigorous imprisonment for life and imposed a fine of Rs 25,000. Other co-accused were also convicted and sentenced for various offences related to the double murder case.
