Maha: HC slams Thane court for shocking relief to police man involved in custodial death of accused Shinde

Mumbai, Feb 27 (Reporter) The Bombay High Court on Thursday expressed “shock” and raised questions over an order passed by a sessions court in Thane, which kept “in abeyance” the findings made by a magistrate in a report questioning the legitimacy of the encounter of an accused in the Badlapur sexual assault case. A bench of Justices Revati Mohite-Dere and Neela Gokhale questioned how the sessions court judge D R Deshpande passed an order that granted relief to policemen in the encounter case was “shocking” and that the judge overreached the High Court order. Thane court had submitted a report on January 18, holding five policemen—senior police inspector Sanjay Shinde of the Thane Crime Branch, assistant police inspector Nilesh More, head constables Abhijeet More and Harish Tawade and police constable Satish Khatal—accountable for Akshay Shinde’s custodial death. The policemen, who were escorting Shinde from Taloja Prison to Kalyan for questioning, had claimed that Shinde snatched API More’s service pistol, leading to a struggle during which both were injured. Accused Shinde had been arrested by the Badlapur police for allegedly sexually assaulting minor girls at a local school. While in judicial custody at Taloja Prison, he was taken into police custody on September 23 via a transfer warrant in connection with a second FIR (first inforation report) lodged by his wife.
