HP govt wins battle in HC against Adani Power

Shimla, July 18 (Reporter) In a major legal victory for the Himachal Pradesh government, the High Court on Thursday set aside the impugned judgment of a single judge directing it to pay Rs 280 crore as upfront premium along with interest to Adani Power in connection with the Jangi Thopan Hydropower project. The Himachal Pradesh High Court, in a detailed 51-page judgment, allowed the Letters Patent Appeal (LPA) No. 166 of 2022 filed by Himachal Pradesh govermemt challenging the single-judge bench in favour of Adani Power. The bigger bench of the High Court said the refund based on selective notings on files, ignoring other relevant material, was unsustainable in law. The Court emphasized that any decision becomes effective only when it is issued and authenticated according to the constitutional provisions. Concurrently, the court dismissed LPA No. 167 of 2022 filed by Adani Power, which sought to enhance the interest on the upfront premium from the date of deposit.
