HC may hear pleas on Thursday challenging WBSSC's teachers recruitment notification

Kolkata, June 4 (Reporter) The Calcutta High Court is expected to hear a set of petitions on Thursday (June 5) challenging the issuance of the West Bengal Secondary Schools Service Commission ( WBSSC) fresh notification seeking applications for recruitment of over 44,000 vacant posts in the teaching and non-teaching staff in the government-aided schools. The notification comes two days after Chief Minister Mamata Banerjee told media that an additional 11,517 posts for classes 9 and 10 teachers, 9,912 posts for classes 11 and 12 teachers and 1,571 vacancies at Group-C and D level have been created for the same selection process. Altogether over 44,000 vacancies are to be filled, the process for which should be completed before December 31. On May 30, the WBSSC issued a notification for recruiting 35,726 teachers for state-aided schools, following a Supreme Court directive to do so by May 31. According to the notification published on the WBSSC website, 23,312 teachers are to be recruited for classes 9-10 and 12,514 for classes 11-12 in secondary and higher secondary schools, respectively. However, a set of petitions was on Tuesday filed before the single judge vacation bench Justice Partha Sarathi Mukherjee, who allowed the petitions, which may likely come up for the first hearing on Thursday, the court sources said. One of the petitioners Lubana Parveen alleged that the notification violated directives previously issued by the Supreme Court on April 3 in which the entire 2016 panel stood cancelled for alleged cash for jobs and directed for the new appointment by December 31 for which a notification is to be issued by May 31. One of the petitioners is a victim candidates in the cash-for-jobs scam. Appearing for the petitioner advocate Firdous Shamim alleged the top court did not authorise the “creation” of a new recruitment rule that allocates 10 marks for the teaching experience. According to his arguments, the new rule for selection by the WBSSC is that the sacked teachers would sit for an exam of 90 marks while other applicants would appear for an exam of 100 marks. The court also allowed separate petitions challenging the format of a fresh selection test for the appointed school teachers from the 2016 panel and chief minister's decision to offer monthly stipend to the Group-C and D staff, who lost jobs by the apex court order. The entire panel of 2016 of 25,752 school teachers and non-teaching staff (Group-C and D) was cancelled by the apex court after a series of hearings. The bench said there was no way to segregate the tainted from the non-tainted candidates. On an appeal by the state, the top court said on April 17 that the non-tainted teachers may be allowed to continue in service until December 31 but they must go through a fresh selection test. Allowing age limit relaxation for these people, the court directed the state to start the process by May 31 and complete it in three months...////...
