New Delhi, Feb 20 (Reporter) A court here on Thursday dismissed a defamation complaint filed by Aam Aadmi Party (AAP) leader and former MLA Satyendar Jain against Bhartiya Janta Party (BJP) MP Bansuri Swaraj. The complainant (Jain) has filed the present complaint under Section 210(1) and 223 BNSS for alleged commission of offence under Section 356 of BNS by the accused persons that is Bansuri Swaraj (sitting MP) and a news channel. The complainant alleged that the accused number 1 (Bansuri Swaraj) had made certain defamatory comments against him in an interview which was aired on October five, 2023, on a news channel (accused number 2) with intent to defame the complainant and gain undue political advantage. It is further stated that accused no 1, a practising lawyer and an MP from the New Delhi Lok Sabha constituency, had made the following defamatory statements against the complainant in context of the raid made by Enforcement Directorate at his house and recovered Rs three crore in cash, 1.8 kg gold and 133 gold coins from there. Jain alleged that the statements were intended to tarnish his reputation and gain undue political advantage. He contended that the complainant is a man of high repute being a three times MLA from Shakur Basti, Delhi and having handled several ministries or portfolios in GNCTD which include Health & Family Welfare, Industries, Home, Water, Urban Development and Irrigation & Flood Control Department. After hearing the case, Additional Chief Judicial Magistrate (ACJM) Neha Mittal said, "This court is of the considered opinion that there does not exist sufficient ground for taking cognizance of the offence punishable under Section 356 of BNS. No other offence appears to be made out from the complaint and documents annexed therewith. Accordingly, cognizance in the present case is declined...////...
