New Delhi, Jan 23, (Reporter) After hearing a senior advocate who alleged that the Court's registry has failed to list a case concerning Adani Power, the Supreme Court on Tuesday announced that the matter will be heard on Wednesday.
Appearing for Jaipur Vidyut Vitran Nigam Limited, Senior Advocate Dushyant Dave expressed concern over the registry's failure to list the case against Adani Power, saying that the situation is "very disturbing." Dave urged the Court to pass a judicial order and also emphasised that such delays should not happen in other courts including the High Courts.
Dave blamed an Assistant Registrar of the apex court for delaying the matter as he was instructed to do so.
A bench comprising Justice Aniruddha Bose and Justice PV Sanjay Kumar took note of the senior advocate’s allegations and posted the matter to the afternoon session.
In the afternoon when the bench assembled, the Court told Dave that it would list the matter for hearing on Wednesday, as item number 1 after fresh matters.
Meanwhile, another petitioner also alleged that he was facing a similar issue on his Public Interest Petition concerning 20 crore people which was to be listed in two weeks but it has been eight weeks now.
In a judgment passed in the year 2020, the apex court held that Adani Power was not entitled to the Late Payment Surcharge (LPS). In terms of the same, the Rajasthan electricity distributor paid the entire amount due, and the same was accepted by Adani.
The petitioner stated that while DISCOM had moved an application for review, which was dismissed in March 2021, Adani did not file any review petition. The Supreme Court had in January last year sought a report from the registry within ten days on allegations by the Jaipur Vidyut Vitran Nigam Limited about such an improper listing of an application by Adani Power despite a final judgment in the case...////...
