SC directs UP Cong Committee to deposit Rs 1 Cr for stay of HC's Order

New Delhi, Jan 19 (Reporter) The Supreme Court on Friday directed the UP Congress Committee to deposit Rs 1 Crore within 4 weeks for a stay of the Allahabad High Court's order directing the UPCC to clear the UPSRTC dues of Rs 2.66 crores. The dues are for using UPSRTC's (Uttar Pradesh State Road Transport Corporation) buses and taxis for political purposes between 1981 and 1989. While issuing notice on the UPCC's Special Leave Petition, the Bench of Justice Surya Kant and Justice K. V. Viswanathan said that the Court will explore the possibility of appointing an arbitrator to determine and ascertain the actual liability of the petitioner. The Top Court directed the UP Congress Committee to “deposit a sum of Rs 1 crore within four weeks so that the rights of both parties are protected. It also directed that when Rs 1 crore is deposited the further recovery shall remain stayed...” The Apex Court was hearing a special leave petition filed by the UPCC against the judgment of Allahabad High Court in October last year directing the UPCC to clear UPSRTC dues with interest at the rate of 5% from the due date within three months...////...
