SC directs DHCBA to reserve 4 out of 10 posts in executive panel for women

New Delhi, Sep 26 (Reporter) The Supreme Court on Thursday directed the Delhi High Court Bar Association (DHCBA) to reserve 4 out of 10 posts in the Executive Committee (EC) in the body for women. A three-judge bench comprising Justice Surya Kant, Justice Dipankar Datta and Justice Ujjal Bhuyan said that four posts under consideration for women should include the post of treasurer. Apart from this, the bar body should consider reserving three more posts for women, the court added. Objections were raised by DHCBA president Mohit Mathur who requested the court to give them four weeks to file a reply as the matter required to be approved by the general body. The Bench said, “Yes that is why we said only on interim arrangement. How many posts do you have? Mathur replied that the Delhi High Court Bar Association has 15 posts. The Bench said, “Out of that 2-3 you can have (reserved).” Mathur replied, that the matter was pending in the High Court but we came here to the Supreme Court thinking it was adversarial. We must be given time to consult the stakeholders, Mathur pleaded. The Court refused to agree. Senior Advocate ANS Nandkarni appearing for Delhi Bar Associations (DBA) said, “We already have 1 post reserved”. Senior Advocate Meenakshi Arora appearing for petitioners said, “Once elections are held then it will become infructuous.” Justice Datta asked Mathur, “How will you allay the apprehensions? When can you have your GB meeting?” "Please do not disarm me. Campaigning (for bar elections) has started," Mathur said. "Our best wishes for your next tenure as well Mr Mathur. Women members will be most capable of handling the treasurer post," Justice Dutta said. The Bench directed DHCBA to hold its General Body Meeting (BBM) within 10 days. “General Body shall consider the desirability of reserving at least post of treasurer for women," the Court said.
