SC allows withdrawal of plea seeking probe into Bengal violence over Waqf Act

New Delhi, Apr 21 (Reporter) The Supreme Court on Monday permitted the withdrawal of a plea that sought a court-monitored investigation into the recent violence in West Bengal’s Murshidabad district, allegedly triggered by protests against the newly-amended Waqf (Amendment) Act. A bench of Justices Surya Kant and N. Kotiswar Singh allowed the petitioner, Advocate Shashank Shekhar Jha (appearing in person) to withdraw his writ petition, while granting him liberty to file a fresh one after proper verification of facts. The bench, however, expressed displeasure at the nature of averments in the petition. “You seem to be in some kind of hurry,” Justice Surya Kant remarked, observing that the allegations were based largely on media reports and lacked proper substantiation. The Court advised the petitioner to ensure due diligence and factual verification before approaching the judiciary with such sensitive claims, especially in the context of communal unrest. The plea had raised concerns over the violence that broke out in areas like Suti, Samserganj, Dhulian, and Jangipur in Murshidabad district on April 11 and 12. Several people were reportedly killed and many displaced as violence flared during protests against the Waqf Act amendments.
