Mumbai police opposes bail plea of accused in Saif Ali Khan stabbing case

Mumbai July 26 (Reporter) Mumbai Police have strongly opposed the bail plea of a Bangladeshi national accused of breaking into actor Saif Ali Khan’s home and stabbing him, an official said here on Saturday. Accused Mohammad Shariful Islam Shehzad, 30 has recently filed a bail application in the session court from jail, claiming that he is falsely implicated in the case while already being charge-sheeted and languishing in jail from a prolonged period. In response to the plea, Police submitted a reply stating that there was strong evidence against accused Shariful Islam as he is a Bangladeshi national illegally residing in India therefore, if he is released on bail, there is a strong possibility that he will flee to Bangladesh. In the reply submitted on July 24, the police cited forensic laboratory findings, reaffirming their assertion that the knife fragments discovered near the actor's spine during the attack—and a segment of the knife recovered from the crime scene—matched the weapon seized from the suspect. The court acknowledged the reply submitted by Khar police and adjourned the further hearing till August 1. It may be recalled that the accused had moved for bail on both technical and merit-based grounds, claiming his arrest was illegal and in violation of Section 47 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The section mandates that a police officer arresting any individual without a warrant must communicate the full particulars of the offence or the grounds for arrest. In his plea he has cited various Supreme Court and High Court judgments that emphasize the requirement to inform the accused of the reasons and grounds for the arrest. He argued that non-compliance renders the arrest unlawful. Earlier the accused had withdrawn the bail plea moved after on April 9 police has filed a chargesheet running into more than 1,000-pages which includes crucial forensic evidence that allegedly connects the arrested suspect to the attack. Khan was repeatedly stabbed with a knife by the intruder inside his 12th floor apartment in upscale Bandra on January 16 this year.
