HC has no idea, says SC while overturning order on abetment of suicide

New Delhi, Oct 3 (Reporter) The Supreme Court on Thursday overturned the Allahabad High Court’s order which held Hindustan Unilever officials guilty of abetment of suicide of an employee who ended his life soon after the company told him to take premature retirement. A Bench comprising Justice J B Pardiwala and Justice Manoj Misra, while setting aside the High Court’s order, said, “The High Court has no idea what constitutes an offence under Section 306 IPC!” The Supreme Court set aside the High Court order and said, “Allowing criminal proceedings to continue under (Section) 306 will be misuse and abuse of process of law. Appeal is allowed, proceedings pending in court are also set aside," the Supreme Court said. The High Court had upheld criminal proceedings against Hindustan Unilever officials under Section 306 of the Indian Penal Code (IPC) (abetment of suicide). The case involved allegations that Hindustan Unilever's recommendation for early retirement led to an employee's death by suicide. The High Court held that the company’s decision amounted to abetment of suicide.
