Gurugram Court orders Retnec Solutions to pay Rs 55 lakh in damages to Microsoft

Gurugram, Jan 28 (Reporter) A commercial court in Gurugram recently ordered Retnec Solutions Pvt Ltd to pay ₹55 lakh in damages to Microsoft after finding the company guilty of trademark infringement and fraudulent call-centre operations using Microsoft’s trademarks, including "HOTMAIL', "OUTLOOK," and "OFFICE 365." Additional District Judge Mahavir Singh issued a permanent injunction restraining Retnec from misusing Microsoft’s trademarks and directed the destruction of all infringing materials. The Court also awarded Microsoft ₹20.6 lakh in litigation costs. "A decree for grant of damages along with punitive damages is passed against defendants no. 1 to 3, directing them to pay an amount of ₹50 lakh to the plaintiffs. They shall be jointly and severally liable to pay this amount," the Court ordered. Defendants no. 7 and 8 were directed to pay an additional ₹5 lakh jointly and severally. Microsoft, a globally recognized technology company, had filed a suit against Retnec Solutions for trademark infringement, passing off, unfair trade practices, dilution, and damages under the Trade Marks Act, of 1999. The tech giant alleged that Retnec impersonated Microsoft personnel and used their trademarks to run fraudulent technical support services, deceiving customers through pop-up messages, cold calls, and unauthorized branding. Investigations revealed that Retnec Solutions operated a fraudulent call centre in Gurugram in collaboration with other entities. Evidence seized during a 2018 police raid included invoices falsely bearing Microsoft's logo, payment records, and scripts detailing tactics to deceive victims with fake pop-ups and scare tactics about malware. After reviewing the evidence, the Court issued a permanent injunction against Retnec Solutions, its directors, affiliates, agents, and anyone acting on its behalf. The Court further directed Retnec to surrender all products and materials bearing Microsoft trademarks, including business brochures, promotional materials, and call scripts, for destruction. Advocates Prashant Gupta, Karan Singh, and Alok Ahlawat represented Microsoft in the case.
