Chennai, May 24 (Reporter) Registering his strong objections to the Kerala government move
to construct a new dam at Mullai Periyar in violation of the Supreme Court order, Tamil
Nadu Chief Minister M.K.Stalin on Friday evening urged the Centre to drop this Kerala's
proposal included in the agenda at the upcoming May 28 meeting of the Expert Appraisal
Committee (EAC).
In a Demi-Official letter to Union Minister of Environment, Forests and Climate Change
Bhupender Yadav, the Chief Minister said Kerala's proposal for constructing a new dam
purportedly in lieu of the existing Mullai Periyar Dam, is against the directions of the
Supreme Court, which and also by Expert Committees, has been repeatedly found
that the dam was safe in all aspects.
It amounted to contempt of court, he said.
The Tamil Nadu government will take strong legal action including initiating contempt
proceedings to prevent Kerala from taking up any such proposals in future if the Apex
Court's orders are not adhered to, the Chief Minister said.
Conveying his Tamil Nadu Government's strong objection to the Union Government’s
consideration of Kerala’s proposal to take up a study for constructing a new dam at
Mullai Periyar, in violation of the orders of Supreme Court, Mr Stalin said "we are
informed that the EAC, under the aegis of the Union Ministry of Environment Forest
and Climate Change (MoEF), has included the above proposal by M/s.Irrigation
Design and Research Board (IDRB), Government of Kerala in the agenda of its
upcoming meeting.
"The above proposal for constructing a new dam by the State of Kerala, purportedly
in lieu of the existing Mullai Periyar Dam, is against the directions of the Hon’ble Supreme
Court", he said and pointed out that. The existing dam has been repeatedly found to be
safe in all aspects by various Expert Committees and has been ruled so by the Supreme
Court in its judgments dated February 27, 2006 and May 7, 2014.
"Later in 2018, when the State of Kerala made an attempt to get approval for the ToR for
EIA study for the proposal for a new dam, the issue was taken up by Tamil Nadu at the
Supreme Court and it was clearly ruled that any such step would require the Court’s
permission", he recalled.
Therefore, the current act of Kerala’s IDRB taking up EIA study for a new dam as well
EAC considering the request for permission to take up the above study would definitely
be in contempt of the orders passed by the Supreme Court, Mr Stalin observed.
"Our objections on this issue have already been communicated in detail by the Additional
Chief Secretary, Water Resources department to the Secretary, MoEF and all the members
of EAC", Mr Stalin added.
"We intend to take strong legal action, including contempt petitions, if the earlier orders of
the Supreme Court are not adhered to by the various stakeholders in this issue", he said.
Urging Mr Bhupender Yadav to instruct the concerned officers of MoEF and the Member
Secretary of the EAC to drop the agenda item on the proposed EIA for the new dam during
the EAC meeting to be held on May 28 and also not to take up any such proposal from Kerala
in the future, he said "considering the sensitivity of the situation, I solicit your immediate
personal intervention in this regard...////...
