Delhi court dismisses revision petition for defamatory remarks filed against AAP leader Saurabh Bhardwaj

New Delhi, Mar 29 (Reporter) A court here on Saturday dismissed a revision petition for defamatory remarks filed against Aam Aadmi Party's leader Saurabh Bhardwaj in September 2018. Special Judge Vishal Gogne after hearing said, "The grounds urged in the revision petition have not been successful in establishing any illegality, error or impropriety in the impugned order. The revision petition is dismissed." Bhartiya Janta Party's (BJP's) leader Suraj Bhan Chauhan had filed revision petition against the order of a trial court, which had earlier dismissed his complaint against Bhardwaj. The revision petition had instituted against the order of the trial court dated February 19, 2025, whereby the trial court dismissed the application of the revisionist under Section 519 of Bhartiya Nagarik Suraksha Sanhita, 2023 (BNSS), read with Section 473 Criminal Procedure Code, seeking condonation of delay in the filing of the complaint. The revisionist filed the complaint in question under Section 2(h) of BNSS for the alleged commission of the offences under Sections 500 and 504 of Indian Penal Code by the proposed accused persons, that is Saurabh Bhardwaj and Sanjay Chauhan (respondents No 1 and 2 respectively). It was alleged by the complainant Chauhan that respondent no 1 (Bhardwaj) held a press conference on September 20, 2018, wherein he alleged that one Santosh Kumar Gupta had lodged an FIR (first information report) against the complainant though no such FIR was lodged against the complainant. It was further stated that as Santosh Kumar Gupta died under mysterious circumstances, by making the aforesaid statement, respondent no 1 (Bhardwaj) levelled serious allegations against the complainant. It was stated that video clips of the aforesaid press conference were disseminated on social media platforms by both respondents. The trial court had on February 19 dismissed Chauhan's plea, saying the alleged offence of defamation took place in September 2018 and observed the limitation period for filing the present complaint was three years. The Magistrate said that the ground given by Chauhan to seek the condonation of delay were not found justifiable and application was dismissed.
