Kolkata, Jan 22 (Reporter) The CBI on Wednesday filed a petition into the Calcutta High Court objecting to the West Bengal government's legal right to appeal on Tuesday seeking death penalty to the convict Sanjay Roy in the rape and murder of a trainee doctor at R.G. Kar Medical College and Hospital here.
The Sessions Court sentenced the civic volunteer to Life Imprisonment on Monday.
Court sources said said the CBI has moved the Calcutta High Court challenging the state's appeal against the life sentence handed to Roy.
The state's plea will be heard by a Division Bench of Justices Debangsu Basak and Md Shabbar Rashidi, who said the matter could be heard in presence of victim’s family, CBI and convict before deciding on its admission.
The advocate appeared for the CBI told the court 'that the state was not authorised to file an appeal against this particular case, which was investigated by the federal agency and they were the competent authority in the case'.
The Calcutta High Court, however, is expected to hear the matter on January 27 once the concerned parties like the parents of the victim and other were informed on the issue.
The Sealdah sessions court on Monday sentenced Sanjay Roy to life imprisonment till death for the rape and murder of an on-duty doctor at the R.G. Kar Medical College and Hospital on August 9, 2024.
The sessions court also asked the Bengal government to pay a compensation of Rs 17 lakh to the victim's parents...////...
