Patna, March 3 (Reporter) RJD member of Bihar Legislative Council Sunil Kumar Singh on Monday requested the Chairman to immediately reinstate his Council membership, which was terminated last year after he did a mimicry of Chief Minister Kumar and called him "Paltu Ram" in the House.
Singh wrote to the chairman here to reinstate his membership in compliance with the judgment of the Supreme Court delivered on February 25.
Singh, in his letter stated that he had earlier written to the chairman on February 26 requesting him to reinstate his membership for upholding the Constitution and the Rule of Law and mentioned that the letter has been received by the office of the chairman.
Referring to the judgement, Singh said the Supreme Court has issued a clear and binding directive regarding his reinstatement with immediate effect.
He said as per articles 141 and 142 of the Constitution of India, all orders of the Supreme Court are binding across the country and must be complied with immediately, in both letter and spirit. Any delay in implementing this judgment may be considered as non-compliance with a binding constitutional directive and may amount to contempt of court.
Singh said the Supreme Court has already held that the presiding officer of a legislative body is answerable and amenable to the Supreme Court's directives.
Singh urged the chairman for reinstatement of his membership and facilitate him in raising issues of public concern in the on-going budget session that started from February 28.
As it is, Singh was terminated from the Upper House for his mimicry of Chief Minister Nitish Kumar on July 26 last year. Singh had done the act of mimicry of Chief Minister Kumar before him in the House on February 13, 2024 during a heated exchange between the opposition and the ruling parties.
Singh had even called the CM "Paltu Ram ", following which the issue of his unruly behaviour was handed over to Ethics committee for investigation. He did not appear before the committee and remained defiant despite several notices issued to him following which his membership was terminated. Singh, later approached the court for relief.
Singh while expressing his pleasure over the Supreme Court judgement restoring his membership of Bihar Legislative Council, had said that justice had ultimately prevailed.
