Shimla, July 3 (Reporter) Depriving a daily wage employee of benefits of regular service for eight years, despite his eligibility, amounts to injustice, the Himachal Pradesh High Court said in an order whose copy was made available on Wednesday.
The court’s observation came with a direction to Himachal Pradesh forest department to give all benefits from a back date to Rashid Mohammed, who became eligible for regularization of service on March 31, 2009, but was regularized on June 12, 2017, a delay of eight years.
The division bench comprising Justice Vivek Singh Thakur and Justice Ranjan Sharma decreed that the petitioner's service should be regularized from April 1, 2009, the date he initially became eligible, and failure to comply would result in a 5% interest penalty on the pending dues to be levied on the responsible officers.
Rashid Mohammed had filed a petition seeking regularization of service from 2009, arguing that he had completed eight years of continuous service from 2001, with the necessary 240 days each year...////...
