New Delhi, Aug 30 (Reporter) A Delhi court on Friday passed an order for framing of murder charges against Former Union Minister and Congress leader Jagdish Tytler in a 1984 anti-Sikh riots case in which three persons were killed. The court listed the matter for September 13 for physical appearance of Tytler in the matter.
Special Judge Rakesh Syal, after hearing arguments on behalf of Prosecution and Defence Counsel, passed the order to frame charges under sections 143 (unlawful assembly), 147 (rioting) 153A (promoting enmity between different groups), 188 (disobedience of the order duly promulgated by a public servant), 295 (injuring or defiling a place of worship), 436 (mischief by fire or explosive substance with intent to destroy house), 451 (house trespass), 380 (theft in dwelling house), 149 (common object), 302 (murder) and 109 (abetment) of Indian Penal Code(IPC).
In this matter, three person Badal Singh, Sardar Thakur Singh and Gurbachan Singh were killed and a place of worship was set ablaze in the Pul Bangash area on November 1, 1984, a day after the then Prime Minister Indira Gandhi was assassinated.
On the recommendations of the Nanavati Commission, the Central Bureau of Investigation (CBI) registered the case afresh in November 2005 and submitted its report.
Additional Chief Metropolitan Magistrate Vidhi Gupta Anand committed the matter to Sessions Judge on September 11 last year by noting in order that Tytler, a former Union minister, was accused of murder (punishable under sections 302 of IPC), an offence "exclusively triable " by courts of sessions...////...
